Terms & Conditions – Definitions

“CVIA Ltd” is the “Supplier” of Services and relates to several brands / businesses / trading names. Our main business as far as these T&Cs are concerned is The CV & Interview Advisors, however, CVIA Ltd also includes the brands / trading names of Incredibly Linked, CVIA Careers, The CVIA Group, The Independent Professionals Business Growth Club, The Career Enhancement Network and DCS Executive.

“CVIA Ltd” is the main “Supplier” of the Services and any sub-contractors, partners or additional suppliers involved in the delivery of said Services. Where the Terms & Conditions use the word “we”, this implies reference to “CVIA Ltd / the Supplier”.

“Services” are the services agreed between CVIA Ltd and the Customer and includes any personal branding, copywriting or career development services, including, but not exclusive to Interview Coaching, Career Coaching, CV / Resume Writing, LinkedIn Profile Writing, Executive Biography Writing, Cover Letter Writing, Supporting Statement Writing and any other Copywriting or Career Development services.

“Customer” is the individual or company who has purchased or received the Services. The Terms & Conditions may refer to the Customer as “you”.

“Personal Branding Collateral” is any written documentation, either physical or digital, provided to the Customer by CVIA Ltd. This includes, but is not exclusive to CVs, Resumes, LinkedIn Profile content, Cover Letters, Website Content, Supporting Statements and Executive Biographies.

“Content” refers to the information contained within the personal branding collateral. “Structure” and “Methodology” refer to the format of the personal branding collateral – for example, the way in which CVIA Ltd structures and writes a CV, including stylistic elements.

Terms & Conditions – General

• Upon agreeing the price and the Terms & Conditions, a binding contract exists between CVIA Ltd and the Customer. Please refer to the Refunds Policy below.

• Prices quoted are valid for one month from the date provided.

• CVIA Ltd cannot undertake to process your request or deliver within any timescales unless expressly agreed in writing. You shall not be capable of making time of the essence. If CVIA Ltd do agree a timescale with you in writing and fail to deliver, then you will only be entitled to a refund of any premiums paid as a sole remedy. CVIA Ltd will not be held liable for any losses directly or indirectly incurred as a result of failure to meet any timescales. We shall not be liable for any consequential or unforeseen losses incurred by you at any time for whatever reason even though you may have brought such matters to our attention.

• CVIA Ltd’s entire liability to you for any losses for any reason howsoever arising shall be limited to the amount of the fees paid.

• Your Personal Branding Collateral including a CV, Resume LinkedIn Profile content, Executive Biography, Cover Letter or Supporting Statement, or any other personal branding collateral / documentation that we produce, either physical or digital, are based upon information that you supply. CVIA Ltd cannot accept responsibility for any false or inaccurate information supplied. It is ultimately you / the customer’s responsibility to ensure that all information contained within the documentation is accurate and correct.

• Any outstanding balance should be made within 24 hours of receiving the first draft of your personal branding collateral. Any amount outstanding beyond this period (unless prior agreed with CVIA Ltd) will be referred to our debt collection partners and will be subject to a surcharge of 20% plus Vat to cover the collection costs incurred. This surcharge together with all other charges and legal fees incurred will be the responsibility of the customer and will be legally enforceable. If the services you receive are being paid for by your employer / previous employer and are not paid within the designated credit period, you will personally and immediately become liable for payment.

• CVIA Ltd will continue to work on your personal branding collateral / documentation, at your request, free of charge for up to 30-days after delivery of the First Draft. We will make as many changes as are necessary to the Content during this period until you are totally satisfied and have accepted the Final Draft. CVIA Ltd will not make changes to the structure or methodology of the personal branding collateral. Should you wish to change any details after a) acceptance or b) expiry of the 30 day period, additional charges may be incurred at our discretion.

• If CVIA Ltd does not hear from you within 30 days of receiving the first draft, you will be deemed to have accepted the document as final. Any changes required after this period may incur an additional charge at our discretion.

• CVIA Ltd specialises in providing coaching and the writing of high-quality personal branding collateral / documentation such as CVs, Resumes, LinkedIn profiles, Cover Letters, Supporting Statements, Executive Biographies and other forms of written collateral, but we can in no way guarantee that the use of our services will result in an interview, job offer or business opportunity.

• We reserve the right to change these terms and conditions at any time and without prior notice and your continued instructions shall be deemed acceptance of any changes.

• Prices are subject to change without notice although all written quotations will be honoured.

• Purchases made from REED.co.uk: Some of our courses are sold on REED.co.uk - under this policy, you may cancel your purchase of the course within the period of 14 calendar days from the date on which the contract of purchase is concluded. This is called a "Cancellation Period". Note that if you redeem your voucher during the Cancellation Period, you expressly request us to begin providing the course materials and you acknowledge that you lose your right to cancel the purchase of the course and get any refund for it.

• CVIA Ltd are bound by GDPR / Data Protection laws and we are registered with the Information Commissioner. We ensure that all information is kept securely and in a confidential manner and in accordance with the Privacy Policy, a copy of which is available on our website. You consent to CVIA Ltd holding your personal data and using it for (a) the performance of any personal branding / copywriting / career development services either for itself or by its agents and subcontractors; (b) for our own internal business and sales and marketing purposes and © you consent to the transfer of your personal data to external agencies for the purposes of administering your account or ensuring payment of all monies owed to CVIA Ltd.

• This contract is written with the sole jurisdiction of English courts and according to English Law.

• These terms and conditions do not affect your statutory rights.

Terms & Conditions – Refunds

Refunds after 6 months of ordering the service:

• A service can be purchased and deferred for up to 6 months. If the service is not started within 6 months and completed within 7 months, the Customer will forfeit the right to a refund, however, providing CVIA are still trading, we will still deliver the service purchased.

Refunds within 6 months of ordering the service:

• In the event of cancellation within 6 months, prior to any work commencing, a full refund will be made, however CVIA Ltd reserves the right to charge an administrative fee of up to £50 + Vat to cover administrative costs and the distribution of intellectual property.

• If cancellation happens after one or more re-scheduling of a coaching session or fact-finding session, which has been instigated by the Customer, a refund will be provided, but CVIA Ltd reserves the right to charge an administrative fee of up to 33% of the total order value net of Vat to cover administrative cost, the distribution of intellectual property and time lost due to postponement of the session.

• If a Customer postpones / cancels a coaching or fact-finding session on more than one occasion, CVIA Ltd reserves the right to cancel the service, refund the Customer’s fee, and charge the client a cancellation fee equivalent to 33% of their total order value net of Vat. In this situation, the Customer has the option to re-book the service on payment of the cancellation fee.

• In the unlikely event of cancellation during a coaching or fact finding session, CVIA Ltd reserves the right to charge up to 50% of the total fee.

• On completion of any coaching or fact finding sessions, the delivery of your services will either be complete or will commence, should you cancel your order after this point, the charge will be discretionary up to and including full payment of the agreed price.

Terms & Conditions for Pro Bono Offer

Eligibility: This offer is open to individuals who are eighteen (18) years of age or older. To be eligible, participants must have been unemployed and not engaged in paid contracting work for a minimum of three (3) consecutive months prior to submitting their application. Employees of CVIA Ltd, their family members, or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter.

Application Process: Participants must submit their application detailing their professional experience and the challenges they have faced. The application must be no more than 500 words. Entries must be made via email to [email protected] or post to CVIA Ltd, 10A Russell Court, Wool Gate, Cottingley Business Park, Bingley, West Yorkshire, BD16 1PE.

Deadline: The closing date for entry will be the end of the month the promotion was advertised. After this date, no further entries to the competition will be permitted.

Selection Process: Each month, CVIA Ltd will review all entries and select one (1) recipient based on the compelling nature of their case, the impact of their professional challenges, and their perceived benefit from receiving the pro bono service. The decision made by CVIA Ltd is final and no correspondence or discussion will be entered into.

Prize: The selected recipient will receive a CV and LinkedIn profile writing service valued at £478 + VAT. The prize is non-transferable and there is no cash alternative.

Notification: The winner will be notified by email and/or letter within 14 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

Usage Rights: By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions and consents to the use of their entry in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

Liability: CVIA Ltd is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition. Furthermore, CVIA Ltd is not liable for any issues arising from the use of the CV and LinkedIn profile writing service once delivered.

Jurisdiction: This competition is governed by the laws of the United Kingdom and any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom.

Amendments: CVIA Ltd reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of any unforeseen circumstances or circumstances outside of its control. Any changes to the competition will be notified to entrants as soon as possible by CVIA Ltd.

Runners up prizes and voucher: Three (3) runners up will be chosen and given 3 months access to The Career Enhancement Network, which contains market-leading careers and winning work guidance for contractors and job seekers. After 3 months, the recipient’s account will be terminated, however, there is an option to pay £19.99 per month to continue using the portal. CVIA Ltd is not liable for any issues arising from the use of The Career Enhancement Network. All nominees and nominators will receive a £25 voucher via email that can be redeemed against any of CVIA Ltd’s services that are of a value of £135 + VAT or above. This voucher has no cash value, is not transferable, and cannot be used in conjunction with any other offer.

Customer Complaints

• CVIA Ltd are dedicated to providing you with high levels of customer service. If you are unhappy with any part of our service, please contact us immediately. Complaints are taken seriously, and we will ensure that the problem is resolved to the best of our ability.

• We offer a money back guarantee, however we would seek to discuss your concerns and offer recompense proportionate to the complaint. Money back guarantee does not necessarily mean the entire fee. For example, we do not offer full refunds for making one spelling error.

• If a complaint is raised and we agree to provide remedial action such as re-writing your CV, this annuls any offer of money back as we will incur additional costs in performing these remedial actions.
